PPK busca dar vuelta al caso Cócteles: evalúa denunciar a fiscales tras fallo del TC
El expresidente Pedro Pablo Kuczynski (PPK) evalúa presentar una denuncia contra los fiscales del Equipo Especial Lava Jato, luego del reciente fallo del Tribunal Constitucional (TC) en el caso Cócteles, según informó su abogado Julio Midolo a Canal N.
El representante legal del exmandatario señaló que existiría un “error judicial generalizado” en los procesos por financiamiento político y anunció que solicitarán el archivo inmediato del proceso penal que afronta Kuczynski por presuntos aportes irregulares a su campaña presidencial de 2016.
Midolo argumentó que la decisión del TC, emitida con cinco votos a favor, “zanja la controversia legal sobre si estos hechos constituían delito al momento de cometerse”. Asimismo, adelantó que la defensa pedirá el levantamiento del impedimento de salida del país, la única medida cautelar vigente contra el exmandatario.
Durante la entrevista, el abogado cuestionó la actuación de los fiscales José Domingo Pérez y Rafael Vela, a quienes acusó de “politizar” casos de financiamiento partidario, como los que involucran a Keiko Fujimori, Ollanta Humala y Alejandro Toledo.
El caso de PPK se enmarca en las investigaciones por presuntos delitos de lavado de activos, falsa declaración y fraude procesal, vinculados a un supuesto aporte de US$100 mil de una empresa del “Club de la Construcción” durante la campaña de 2016.
Con este escenario, la defensa del exmandatario busca que el reciente fallo del TC marque un precedente legal aplicable a su caso y redefina el alcance de las investigaciones por aportes políticos previos a 2016.
